The Board of Commissioners of the Village of Palos Park, Cook County, Illinois held its regular meeting on Monday, August 13, 2018. Mayor Mahoney called the meeting to order at 7:30 p.m. Answering to roll call were Commissioners Reed, Polk, Pavlatos, and Mayor Mahoney, Commissioner Milovich-Walters was not in attendance.

Also in attendance were Marie Arrigoni, Village Clerk; Rick Boehm, Village Manager; Tom Bayer, Village Attorney; Howard Jablecki, Assistant Village Attorney; Michael Sibrava, Public Works Director; Barb Maziarek, Finance Director, Joe Miller, Police Chief; Mose Rickey, Recreation & Parks Director, Kathy May, Administrative Analyst; and Cathy Gabel, Deputy Clerk.

APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING HELD ON JULY 9, 2018: Commissioner Polk moved, seconded by Commissioner Pavlatos, to approve the minutes of the Regular Council Meeting held on July 9, 2018 as presented.

On the call of the roll, the vote was as follows:

RECOGNITIONS/PROCLAMATIONS/APPOINTMENTS/PRESENTATIONS: REPUBLIC RECYCLING: A short presentation on recycling was given by Ernie Lopez of Republic Services. By simplifying recycling and raising awareness, Republic Services can minimize the environmental impact and make local recycling programs sustainable, both now and for future generations. Trends were discussed in recycling. Previously one of the largest global customers for U.S. recyclables, China recently changed its acceptance criteria for contamination levels. Contamination occurs when recyclables are soiled by leftover food or drink. In some communities, contamination levels are as high as 30%. Mr. Lopez emphasized the need for curbside recycling and offered a quick tip for residents – make sure recyclables are empty, clean and dry before tossing them into the recycling container as this will prevent contamination. By recycling plastic, paper, cardboard, aluminum cans, and glass we're able to reduce our dependence on landfills and reuse these materials for future use. It was also noted that some items require special handling. Computers and electronics, paint, yard waste and paint should never be mixed with regular recycling.

NATIONAL PAYROLL WEEK: Mayor Mahoney proclaimed the first full week of September 2018 as National Payroll Week. The proclamation pays tribute to the more than 150 million people who work in and the payroll professionals who support the American system by paying wages, reporting worker earnings and withholding federal employment taxes.

CONSTITUTION WEEK: Mayor Mahoney proclaimed September 17-23, 2018 as Constitution Week in Palos Park and urged all citizens to study the Constitution and reflect on the privilege of being an American citizen and all the rights and responsibilities which that privilege involves.

RECREATION ADVISORY COMMISSION APPOINTMENT: Recreation Advisory members are appointed to serve three year terms with the option of being reappointed at the conclusion of the term or appointed to complete the term of a vacancy. Mayor Mahoney entertained a motion to appoint Jean Marquez to fill a vacancy expiring June 2020.

Commissioner Polk moved, seconded by Commissioner Reed, to approve the appointment of Jean Marquez to fill a vacancy expiring June 2020.

Commissioner Reed moved, seconded by Commissioner Polk to:

A. approve Holy Family Villa Golf Invitational Raffle License and Raffle Manager Bond Waiver

Request for raffle to be held on August 23, 2018 at Gleneagles Country Club

B. approve Palos Professional Firefighters Raffle License and Raffle Manager Bond Waiver Request for raffle to be held on October 1, 2018 at Station #1,8815 West 123rd Street, Palos Park, IL

C. adopt an ordinance declaring certain personal property owned by the Village as surplus and authorizing the donation of same.--the ordinance states the Village has four (4) pieces of outdated IT equipment which are no longer necessary or useful and that the best interest of the Village would be served by the donation of same to Assisted Technology Exchange Network

D. ratify the Village's employee health care program to include Blue Cross/Blue Shield for the medical and dental portions of the program, Principal for core life and AD&D coverage, Principal for voluntary life and VSP for voluntary vision for the time period August 1, 2018 - July 31, 2019

E. waive bids and approve the proposal from Airy's Inc. in the amount of $33,843.00 for repairing the 4" force main from the 93rd Avenue Lift Station

F. ratify payment of invoices on the Warrant List dated July 23, 2018 in the amount of $57,508.66

G. approve payment of invoices on the Warrant List dated August 13, 2018 in the amount of $91,607.50

H. approve the Supplemental Warrant List dated August 13, 2018 for manual checks, payroll, and recurring wire transfers in the amount of $456,895.80

OLD BUSINESS: None

BOARD, COMMISSION AND COMMITTEE RECOMMENDATIONS: ORDINANCE APPROVING CERTAIN FRONT YARD AND SIDE YARD SETBACK VARIATIONS: Zoning Board of Appeals met on July 11, 2018 to consider the variations from the requirements of Chapter 1268.02(e) Front Yards and Chapter 1268.02(f) Side Yards of the Village Code to permit construction of a front porch, a first floor garage addition and second floor addition to an existing non-conforming single family residence. Where the required front yard setback is 33.69 feet, the applicant is requesting a front yard setback of 24.75 feet for the front porch and 32.75 feet for the garage addition. Where the required side yard setback is 15 feet, the applicant is requesting a 9.06 foot setback from the side lot line at property commonly known as 7934 W. 121 Street, Palos Park, IL. The applicant proposes to construct a 397 square foot second floor addition on the existing 1,900 square foot single story dwelling that will include a 76 square foot garage addition and a new 158 square foot covered front porch. The total area of all the new additions is 700 square feet or 36.8% of the existing dwelling. Several neighbors attended the Zoning Board of Appeals meeting all supporting the request. Finding the proposed improvement was consistent with the character of the surrounding area and the small size of the lot created an undue burden under the strict application of the Code, Zoning Board of Appeals voted (4-0) to recommend approval of the requested variations.

Commissioner Reed moved, seconded by Commissioner Pavlatos, to accept the recommendation of the Zoning Board of Appeals and approve the ordinance for the requested .94 and 8.94 foot front setback variances and the 5.94 foot side setback as required by Chapter 1268.02 (e) and (f) of the Village of Palos Park Code and rear yard variance of 14.5 feet from the required 50 feet from Chapter 1268.02 (g) of the Village Code.

SMALL WIRELESS FACILITIES DEPLOYMENT ACT; SB 1451 created the Small Wireless Facilities Deployment Act and was signed into law on April 12, 2018 as Public Act 100-0585. The Act's primary goal is to allow the telecommunications industry to roll out a 5G telecommunications network in the next several years with minimal input by local governments regarding the placement of small cell installations. To create an effective 5G network, the industry has indicated small cell antennas must be placed in populated areas approximately every 200-300 feet, typically on utility or other poles in the right-of-way. The Act specifies how municipalities may regulate the colocation of small cell antenna installations. To ensure compliance, our Village Attorney developed zoning amendments to regulate small cell installations, consistent with the Act and written design standards for Small Wireless Facilities. Plan Commission met on July 19, 2018 to consider the zoning amendments and design guidelines and voted (5-0) to recommend approval understanding that the proposed amendments were necessary to provide the Village with the greatest amount of control over small wireless facilities. Plan Commission further recommended that the proposed design guidelines encourage colocation of small wireless facilities and require that new utility poles installed for these facilities be constructed of materials consistent with other utility poles in the surrounding area.

0 Plan Commission met on July 19, 2018 to consider the proposed zoning amendment and design guidelines. Finding the proposed amendments were necessary to provide the Village with the greatest amount of control over small wireless facilities, Plan Commission voted (5-0) to recommend approval of the requested zoning text amendment to the Village Code. Plan Commission further recommended the proposed design guidelines encourage colocation of small wireless facilities and require that new utility poles installed for these facilities be constructed of materials consistent with other utility poles in the surrounding area.

Commissioner Reed moved, seconded by Commissioner Pavlatos, to approve Ordinance 2018-24 Amending Various Sections of the Village of Palos Park Zoning Ordinance Relative to Small Wireless also Ordinance 2018-25 Amending the Palos Park Village Code Relative to the Permitting, Regulation, and Deployment of Small Wireless Facilities and Resolution 2018-R-07 Adopting Written Design Standards for Small Wireless Facilities and to amend the reference of existing trees having a six (6) inch diameter to six (6) inch diameter or larger.

INFORMATION & UPDATES: COMMISSIONER OF PUBLIC WORKS AND STREETS/RECREATION & PARKS, NICOLE MILOVICH-WALTERS:

PURCHASE OF 2019 POLICE MODEL FORD EXPLORER: The 2012 Ford Explorer #252 currently being used by the Police Department will be retired and used by another department. Public Works received three quotes for a 2019 Ford Utility Police Interceptor AWD. Prices quoted do not include specialized equipment that would be added by the Palos Park Police Department once the vehicle arrives. The lowest quote was submitted by Suburban Purchasing Cooperative for $28,139.00 and includes a three year 100,000 mile warranty.

Commissioner Polk moved, seconded by Commissioner Reed, to waive the bidding process and accept the proposal from Suburban Purchasing Cooperative for $28,139.00 to purchase a 2019 Police Model Ford Explorer.

2019 MFT PAVING PROGRAM: At the June 6, 2018 Village Council meeting Public Works asked for and received approval to go out to bid on the 2019 MFT Program. On July 27, 2018, six (6) bids were submitted. The lowest responsible bidder was Lindahl Brothers (formerly Crowley-Shepard) of Chicago Ridge. Their bid was $544,935.00. The Engineer's Estimate was $672,487.50. IDOT will not allow any bid to run more than 10% over the contract quantities, Public Works is asking approval to award the MFT Contract to Lindahl Brothers in the amount of $544,935.00 and to give the Village Engineer approval to increase the quantities to the maximum allowed by IDOT with a contract amount not to exceed $600,000.00

Commissioner Reed moved, seconded by Commissioner Polk, to award the 2019 MFT project to Lindahl Brothers in the amount of $544,935.00 and to give the Village Engineer the authority to increase the project quantities to the maximum IDOT will allow with a contract amount not to exceed $600,000.00.

COMMISSIONER OF BUILDING & PUBLIC PROPERTY, G. DARRYL REED: PERMIT ASSISTANCE: Residents are reminded to contact the Building Department at 708.671.3730 with any questions regarding building permits or help in planning a home project.

BUILDING DEPARTMENT REPORT: Commissioner Reed reported the Building Department issued thirty-six (36) permits from July 4, 2018 - August 7, 2018 resulting in $12,748.05 in fees. Eighty-four (84) inspections were completed during this time, no occupancy permits issued and no exaction fees collected.

COMMISSIONER OF PUBLIC HEALTH AND SAFETY, DANIEL POLK POLICE ACTIVITY REPORT: Commissioner Polk reported the Police Department received 3,381 calls for service from July 9, 2018 through August 13, 2018. Palos Park Police also issued 138 adjudication tickets, 68 traffic tickets, 112 written warnings, 79 verbal warnings, completed 45 case reports, arrested 23 adults, 2 juveniles, 15 impounds, 34 senior checks, 67 citizen assists and 60 community contact hours,

AUTUMN IN THE PARK ROAD CLOSURE: Mayor Mahoney reminded residents that on Saturday, September 15th, 123rd Street (McCarthy Road) will be closed between 96th Avenue (LaGrange Road) and 80th Avenue from 9:00 a.m. to 1:00 p.m. The Autumn in the Park parade steps off at 11:00 a.m, from the Metra Train Station (8200 W. 123 Street) and ends on the Village Green. Residents are asked to adjust their plans accordingly. If you have any questions or concerns please feel free to call the Police Department at 708.671.3770.

STOP THE BLEED PROGRAM: Palos Park Police Officers will undergo training this month in an effort to prepare officers responding to traumatic events involving massive bleeding. The “Stop the Bleed" Program focuses on identifying where the bleeding is coming from and how to control the bleeding by applying tourniquets, packing wounds, and applying pressure. Proper training can mean preventing a manageable wound from turning into a life-threatening one. Since police officers are often among the first to arrive at the scene of an injury, it makes sense for officers to be equipped and ready to administer blood control measures that could save a person's life.

COMMISSIONER OF ACCOUNTS AND FINANCES, JAMES PAVLATOS: Commissioner Pavlatos had no formal report this evening.

MAYOR'S REPORT: Mayor Mahoney had no formal report this evening.

CLERK'S REPORT: Clerk Arrigoni had no formal report this evening.

MANAGER'S REPORT: ELECTRIC AGGREGATION: Manager Boehm reported residents have received letters addressing electric aggregation in the Village. “Opt-Out Notices" have also been provided to customers informing them of their ability to opt-out of the program. The electric aggregation is not necessarily going to save residents money as they will be charged a rate equal to Com Ed.

By keeping the electric aggregation program it allows us to bid next year. Commissioner Reed brought up the fact that residents who stay in our aggregation program will be split between Com Ed and MC Squared based on their usage. He questioned who made that determination and what the threshold for usage is. Manager Boehm stated he will look further into the matter and report back to Council.

CITIZENS AND VISITORS COMMENT PERIOD: Robert Biel: Mr. Biel reported to Council that the neighbors' fence that is on his property was to have been removed. To date it has not been taken down.

ADJOURNMENT OF REGULAR COUNCIL MEETING: There being no further business, Commissioner Reed moved, seconded by Commissioner Polk, to adjourn the meeting at 8:50 p.m.

Upon voice vote, the motion passed with 4 yes votes.
