PROPOSED ORDINANCE AMENDMENT

SERVICES PROVIDED PURSUANT TO INTERGOVERNMENTAL AGREEMENT AND MEMORANDUM OF UNDERSTANDING

BE IT ORDAINED, by the Cook County Board of Commissioners, that CHAPTER 2 - ADMINISTRATION, ARTICLE IV. - OFFICERS AND EMPLOYEES, DIVISION 5. - INSPECTOR GENERAL, Sec. 2-284 of the Cook County Code is hereby amended as Follows:

Sec. 2-284. - Functions, authority and powers.

In addition to other powers conferred herein, the OIIG shall have the following functions, authority and powers:

(1) To receive and register complaints and information concerning corruption, fraud, waste, mismanagement, unlawful political discrimination and misconduct in the operations of County Government; including, but not limited to any County contract, grant, lease, license, or application or certification of eligibility for the same; all County employees, departments, bureaus, boards, agencies, agents, or independent contractors; appointed officials, and elected officials in the performance of their official duties; contractors and subcontractors providing goods and services pursuant to a County contract; and all persons and business entities seeking County contracts or certification of eligibility for County contracts.

(a) Complaints and other documents, relating to the Independent Inspector General's investigations of elected officials, shall be verified by certification. The several matters stated in the complaints and other documents shall be stated positively or upon information and belief only, according to the fact. Nothing in this Section shall restrict the Independent Inspector General from exercising his/her independent judgment, based upon an articulable suspicion, to initiate an investigation of an elected official, notwithstanding the existence of any unverified information, or documents, statements and claims submitted anonymously.

(b) The person having knowledge of the matters stated in the complaint or other document certified in accordance with this Section shall subscribe to a certification in substantially the following form: Under penalties as provided by law pursuant to Section 2-291 of the Office of Independent Inspector General Ordinance, the undersigned certifies that the statements set forth in this instrument are true and correct, except as to matters therein stated to be on information and belief and as to such matters the undersigned certifies as aforesaid that he verily believes the same to be true.

(c) Any complaint and other document, relating to the Independent Inspector General's investigations, certified in accordance with this Section may be used in the same manner and with the same force and effect as though subscribed and sworn to under oath. (d) Any person who intentionally makes a false statement, material to the issue or point in question, in any complaint or other document relating to the Independent Inspector General's investigations of elected officials, and which is certified by such person in accordance with this Section shall be guilty of knowingly furnishing false statements or misleading information and shall be subject to violations and penalties in Section 2-291.

(2) To investigate corruption, fraud, waste, mismanagement, unlawful political discrimination and misconduct in operations of County Government under the Offices of the President as well as the separately elected County officials, either in response to such complaints or on the Independent Inspector General's own initiative, or in the proper case, to refer complaints and information to an outside law enforcement agency.

(3) To promulgate rules and regulations for the conduct of investigations consistent with the requirements of equal protection, due process and this division.

(4) To request information from and to conduct interviews under oath with County employees, officials, agents, contractors, subcontractors, licensees, grantees or persons or businesses seeking County contracts, grants, licenses, or certification of eligibility for County contracts, for the purpose of investigation of corruption, fraud, waste, mismanagement, unlawful political discrimination, or misconduct. This includes the power to review past, present, and proposed County programs, accounts, records, contracts and transactions.

(5) To prepare confidential reports and make recommendations for corrective action as outlined in Section 2-285.

(6) To notify the State's Attorney or other appropriate law enforcement authority if the Independent Inspector General determines or suspects that possible criminal conduct has occurred, and to promptly tender to such authorities any evidence or information which has been obtained by the Independent Inspector General. In the event an investigation by the OIIG threatens to interfere with an investigation by a different county, city, state, or federal law enforcement agency, the OIIG will cooperate in all respects with such law enforcement agency. The OIIG shall acquiesce in its investigation only upon written request of another law enforcement agency.

(7) To notify the Cook County Board of Ethics if the Independent Inspector General determines that a violation of the Cook County Ethics Ordinance has occurred by submitting to the Board of Ethics a copy of the investigation report described in Section 2-288.

(8) To serve as liaison between County Government and law enforcement authorities regarding any matters which have been referred to such authorities by the Independent Inspector General.

(9) To provide quarterly reports to the President and Members of the County Board as outlined in Section 2-287.

(10) To create and maintain a toll-free "Office of the Independent Inspector General Hotline" for the purpose of receiving reports of corruption, fraud, waste, mismanagement, unlawful political discrimination and misconduct. The identity of any individual placing a call to the Office of the Inspector General Hotline shall be kept confidential during and after the investigation of any complaint made by the caller, unless the caller consents to disclosure of his or her name or disclosure of the caller's identity is otherwise required by law. Alternatively, reports may be made anonymously.

(11) Notwithstanding any other provision of this Section, the Independent Inspector General shall cooperate with the Shakman Compliance Administrator and fulfill the obligations required in the Supplemental Relief Order entered into by Cook County in Shakman et al. vs. The Democratic Organization of Cook County, et al. No. 69 C 2145 (United States District Court for the Northern District of Illinois), including providing copies of complaints, investigating unlawful political discrimination expeditiously, reporting the results to the Shakman Compliance Administrator, and providing the Shakman Compliance Administrator with quarterly reports.

(12) The Independent Inspector General shall have, subject to budgetary allocation by the County Board, the sole power to appoint, employ, and remove such assistants, employees and personnel and establish personnel procedures as deemed necessary for the efficient and effective administration of the OIIG.

(13) To provide a proposed budget request within 90 days of his/her initial appointment and annually thereafter pursuant to the County's fiscal year budget rules and regulations. (14) To provide services pursuant to any intergovernmental agreement or memorandum of understanding approved by the Board of Commissioners to which the OIIG is a party.

PROPOSED RESOLUTION

REQUESTING STATE’S ATTORNEY KIM FOXX TO APPEAR BEFORE THE BOARD OF COMMISSIONERS TO DISCUSS THE STATE’S ATTORNEYS OFFICE’S DECISION TO DISMISS ALL CHARGES IN THE JUSSIE SMOLLETT CASE

WHEREAS, Jussie Smollett alleged that he was a victim of a racist and homophobic hate crime in the City of Chicago, County of Cook; and

WHEREAS, the alleged hate crime attack immediately received global media attention and the immeasurable impact of this case has reflected poorly on the City of Chicago and Cook County government; and

WHEREAS, the Chicago Police Department expended valuable resources to investigate the hate crime attack alleged by Mr. Smollett; and

WHEREAS, the investigation by the Chicago Police Department revealed that the alleged hate crime

never occurred and was, in fact, staged by Jussie Smollett; and

WHEREAS, Jussie Smollett was indicted by a Cook County Grand Jury on 16felony counts after

allegedly lying to police about being the victim of a racist and homophobic hate crime; and

WHEREAS, the decision by State’s Attorney Kim Foxx and her office to adjudicate the Smollett case in an unprecedented manner caught the Mayor of Chicago and the Chicago Police Superintendent completely off-guard and has left much doubt and many questions yet to be answered; and

WHEREAS, the overwhelming reaction from the legal community has been of shock and surprise by the decision and it has left a negative perception that the State’s Attorney’s Office was neither fair and equitable nor transparent in the adjudication of the Smollett case; and

WHEREAS, Cook County constituents deserve nothing less than honest and transparent answers to this very troubling case; and

NOW, THEREFORE, BE IT RESOLVED, that the Cook County Board of Commissioners does hereby request that State’s Attorney Foxx appear before the next scheduled Finance Committee of the Board of Cook County Commissioners to discuss the decision to dismiss all charges against Mr. Jussie Smollett; and

BE IT FURTHER RESOLVED, that Cook County State’s Attorney Kim Foxx be prepared to discuss in-depth and take questions on the decision made by her office on the Jussie Smollett case..end

Summary: Resolution 14-4341 directs that a report of all special purpose fund transactions be made to the Secretary of the Cook County Board of Commissioners by the office or agency responsible for administering each special purpose fund on a quarterly basis.

Reports shall be provided to the Secretary's office no later than 30days after the end of each fiscal quarter, at which point the Secretary will aggregate the reports for distribution to the Board of Commissioners and the Director of Budget and Management Services on the next available Board Agenda;

PROPOSED ORDINANCE AMENDMENT AMENDMENT TO CABLE TELEVISION ORDINANCE

BE IT ORDAINED, by the Cook County Board of Commissioners, that Chapter 78, Telecommunications, Section 78-52 of the Cook County Code is hereby amended as Follows:

Sec. 78-52. Cable/video service provider fee and PEG access support fee.

(d) PEG Access Support Fee Imposed.

(1) A PEG access support fee is hereby imposed on any Holder providing cable service or video service in unincorporated Cook County in addition to the fee imposed pursuant to Subsection (c).

(2) The amount of the PEG access support fee imposed hereby shall be one percent of the Holder's gross revenues or, if greater, the percentage of gross revenues that incumbent cable operators pay to the County or its designee for PEG access support in unincorporated Cook County.

(3) The Holder shall pay the PEG access support fee to the County or to the entity designated by the County to manage PEG access. The Holder's liability for the PEG access support fee shall commence on the date set forth in Subsection (c).

(4) The payment of the PEG access support fee shall be due on a quarterly basis, 45 days after the close of the calendar quarter. If mailed, the fee is considered paid on the date it is postmarked. Each payment shall include a statement explaining the basis for the calculation of the fee.

(5) An incumbent cable operator that elects to terminate an existing agreement pursuant to 220 ILCS 5/21-301(c) shall pay, at the time they would have been due, all monetary payments for PEG access that would have been due during the remaining term of the agreement had it not been terminated pursuant to that section. All payments made by an incumbent cable operator pursuant to the previous sentence may be credited against the fees that that operator owes under this Subsection (d).

The revenue collected shall be placed in a special revenue fund named “PEG Access Support Fund” created by the Comptroller, held by the Treasurer of the County, and expended exclusively for capital costs associated with PEG access and support for the County's Government Access Channel, upon appropriation of the County Board.

FURTHER ORDAINED, by the Cook County Board of Commissioners, that Chapter 2, Administration, Section 2-434 of the Cook County Code is hereby amended as follows:

Sec. 2-434. - Power and duties of Director of Revenue.

The Department of Revenue shall have the following powers and duties:

(1) To administer and enforce all of the responsibilities, powers and duties delegated to it in every County tax or fee ordinance. However, when those tax revenues are collected by the State for and in behalf of the County, and remitted to the County, the Department shall act solely in an advisory capacity with respect to those collections.

(2) To collect cable television franchise fees and tax revenue, other than property taxes, formerly collected by other officers, and to succeed to all responsibilities, powers and duties relating to cable television franchise fees and tax collections previously delegated to the County Collector, Bureau of Finance and Bureau of Administration.

PROPOSED ORDINANCE AMENDMENT

ANIMAL AND RABIES CONTROL ORDINANCE

BE IT ORDAINED, by the Cook County Board of Commissioners, that Chapter 10, Animals, Sections 10-2, 10-7, 10-8, 10-9, 10-42, 10-78, 10-87, and 10-99, of the Cook County Code are hereby amended as follows:

Sec. 10-2. - Definitions.

The following words, terms and phrases, when used in this chapter shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Bite means seizure of a person or companion animal with the jaws or teeth of any cat, dog or other animal capable of transmitting rabies so that the person or companion animal so seized has been wounded or pierced and further includes contact of the saliva of cat, dog or other animal with any break or abrasion of the skin.

Companion animal means a domesticated or domestic-bred animal whose physical, emotional, behavioral and social needs can be readily met as a companion in the home, or in close daily relationship with humans.

***

Scratch means to score, mark or break the skin of a human or companion animal, by a dog, cat or ferret, using nail or tooth.

Sec. 10-7. - Powers of municipalities and other political subdivisions to regulate animals.

Nothing in this chapter shall be held to limit, the power of any municipality or other political subdivision to prohibit animals from running at largebeing off leash, nor shall anything in this chapter be construed to limit the power of any municipality or other political subdivision to further control and regulate animals in such municipality or other political subdivision by enacting stricter requirements, including a requirement of inoculation with rabies vaccine.

Sec. 10-8. - Animal care.

(p) No person shall permit at any time their animal to:

(1) Run uncontrolledBe off leash, except in accordance with applicable law or regulation(s); (2) Molest persons or vehicles by chasing, barking or biting;

(3) Attack other animals;

(4) Damage property other than the owner's.

Sec. 10-9. - Stray animals.

(a) Whenever an Animal Control Warden observes or is informed that an animal is a stray or is off leash and not under the control of the owner, the animal shall be immediately apprehended and impounded. Any person may apprehend a stray animal and inform the local police or the Administrator so that the stray animal can be impounded. Stray animals impounded by the Department of Animal and Rabies Control shall be kept at a location closest to the point at which the stray animal is apprehended. A minimum of two impoundment locations shall be used by the Department, one optimally convenient to that portion of the County outside the City of Chicago lying north of the Eisenhower Expressway and one optimally convenient to that portion of the County outside the City of Chicago lying south of the Eisenhower Expressway.

Sec. 10-42. - Biting animal capable of transmitting rabies.

(a) It shall be unlawful for any person knowing that an individual or companion animal has been bitten or scratched by an animal to refuse to notify, within 24 hours, the police or other officer with the delegated authority who are responsible for the area in which the bite occurred.

(b) Except as otherwise provided by State law with respect to police dogs, when the Administrator receives information that any person or companion animal has been bitten or scratched by an animal the Administrator shall have the owner confine the biting animal under observation of a licensed veterinarian for a period of ten days beginning within 24 hours of the biting incident. The biting animal may be confined in the house of its owner in a manner which will prohibit it from biting any person or animal if the animal is currently vaccinated with an approved rabies vaccine. Caged animals such as rats, guinea pigs, rabbits, etc., can be placed under home confinement.

(1) When the biting animal is currently inoculated with rabies vaccine the animal's health shall be reported by the veterinarian to the Cook County Department of Animal and Rabies Control on the first and tenth days of the observation period for rabies.

(2) When the biting animal is not currently inoculated with rabies vaccine the animal shall be confined for ten days in a veterinary hospital or animal control or humane shelter provided there is a veterinarian daily on the premises.

(c) Confirmation of the health of the biting of the animal shall be sent by the veterinarian to the Cook County Department of Animal and Rabies Control within 24 hours of the first and final examinations. Official forms shall be provided by the Department.

(d) When an animal confined for biting or scratching shows signs of rabies or acts in a manner which would lead a person to believe that an animal may have rabies, the owner or veterinarian shall notify the Administrator immediately by the telephone or in person of these signs. The Administrator shall immediately notify the physician attending the bitten or scratched person or responsible health agency as soon as the Administrator receives notice of such signs and shall securely confine the animal.

(e) If the animal confined is determined not to be infected with rabies at the end of the period of confinement, it shall be released from quarantine. The animal owner shall show proof of rabies inoculation for the animal and shall pay any fee, charge or penalty including any fee for veterinary services attributed to the bite. A confined animal, when not redeemed by the owner may be disposed of in accordance with State law.

(f) It shall be unlawful for the owner of a biting or scratching animal to euthanize, sell, give away or otherwise dispose of, or have inoculated against rabies the animal known to have bitten or scratched a person until it has been released from confinement for observation for rabies by the Administrator. It shall be unlawful for the owner of such animal to refuse or fail to comply with the written or printed instructions cannot be delivered in person they shall be mailed to the owner of such animal by regular mail, postage prepaid, return receipt requested. The affidavit of testimony of the Administrator delivering or mailing such instructions is prima facie evidence that the owner of such animal was notified of their responsibilities.

Sec. 10-78. - Declaration of a "vicious" dog.

(a) A dog may be declared vicious if the Court determines that without justification, the dog attacks a person or companion animal causing serious physical injury or death, or any individual dog that has been found to be a "dangerous dog" upon three separate occasions.

(b) In order to have a dog deemed "vicious," the County Animal Control Administrator must give notice of the infraction that is the basis of the investigation to the owner, conduct a thorough investigation, interview any witnesses, including the owner, gather any existing medical records, veterinary medical records or behavioral evidence, and make a detailed report recommending a finding that the dog is a vicious dog and give the report to the State's Attorney's office and the owner.

(c) A complaint may be filed in the Circuit Court of the County after a complete investigation by the County Animal Control Administrator, or designee. The County Department of Animal Control shall accept requests for investigation by any party. Such investigation shall follow these requirements:

(1) The investigation must be thorough and include interviews with witnesses to the conduct in question;

(2) Medical records concerning the injuries inflicted on the person or companion animal of the alleged vicious conduct and veterinary records of the dog regarding behavioral evidence must be gathered and reviewed;

(3) A detailed report must be provided to the Office of the State's Attorney and the owner of the dog recommending a finding that the dog is or is not vicious;

(4) The Animal Control Administrator shall determine whether the dog shall be confined, and if so where, during the pendency of the case.

Sec. 10-87. - Penalties; vicious dog.

If the owner of a vicious dog subject to enclosure:

(1) Fails to maintain or keep the dog in an enclosure or fails to spay or neuter the dog;

(2) The dog inflicts serious physical injury upon any other person or companion animal or causes the death of another person or companion animal; and

(3) The attack is unprovoked in a place where such person or companion animal is peaceably conducting himself or herself and where such person or companion animal may lawfully be;

the owner shall be guilty of a Class 4 felony unless the owner knowingly allowed the dog to run at largebe off leash or failed to take steps to keep the dog in an enclosure then the owner shall be guilty of a Class 3 felony. The penalty provided in this section shall be in addition to any other criminal or civil sanction provided by law.

Sec. 10-99. - Effective date.

PROPOSED RESOLUTION

DIVISION STREET ECONOMIC DEVELOPMENT PROGRAM (EDP) GRANT AWARD ACCEPTANCE RESOLUTION

WHEREAS, the value of infrastructure improvement to economic development and job creation in Cook County has been prioritized in the County’s Long Range Transportation Plan, Connecting Cook County; and

WHEREAS, the City of Blue Island has jurisdictional authority of Division Street from 119th Street to 123rd Street, and Division Street provides needed access to freight companies located in the Blue Island yard area; and

WHEREAS, Cook County is willing to act as the lead agent for roadway improvements along Division Street and is an eligible applicant for funding from the Illinois Department of Transportation (IDOT); and

WHEREAS, Cook County, on behalf of the City of Blue Island, applied to IDOT for Economic Development Program (EDP) monies and was awarded $2,000,000for roadway engineering and construction; and

WHEREAS, this grant requires local match of $200,000.00, which is funded by 11300.1500.540370

P22823 A10532, and the funding period is 9/21/17 through 9/21/22;, and

NOW, THEREFORE, BE IT RESOLVED, that the President of the Board of Commissioners of Cook County and/or her designee, the Superintendent of the Department of Transportation and Highways (DOTH), is hereby authorized to execute such documents as required to accept the sum of Two Million and NO/100dollars ($2,000,000.00) from the Illinois Department of Transportation’s Economic Development Program for the Phase I and II engineering in addition to construction and construction management of this improvement; and

BE IT FURTHER RESOLVED, that this Grant Award shall be used by the Department of Transportation and Highways for roadway improvements for Division Street where the scope of work shall include the reconstruction of existing pavement to concrete pavement, drainage improvements, and other necessary highway appurtenances and shall be designated as Section: 17-IICFR-01-PV; and

BE IT FURTHER RESOLVED, that the improvement shall be constructed by contract; and

BE IT FURTHER RESOLVED, that the Department of Transportation and Highways will submit this Grant Award to the Department of Budget and Management Services to be included in their quarterly Grant report for all awards received to the Board of Commissioners; and

SOUTHWEST COOK COUNTY TRUCKING STUDY STATEWIDE PLANNING AND RESEARCH PROGRAM GRANT AWARD ACCEPTANCE RESOLUTION

WHEREAS, the value of infrastructure improvement to economic development and job creation in Cook County has been prioritized in the County’s Long Range Transportation Plan, Connecting Cook County, and the Cook County Freight Plan; and

WHEREAS, Southwest Cook County is a major industrial and logistics cluster in northeast Illinois, which imposes significant demands on the transportation network but supports regional economic activity; and

WHEREAS, Cook County applied to the Illinois Department of Transportation (IDOT) for Statewide Planning and Research Program monies and was awarded $224,000for a planning study to study existing conditions of the transportation network, identify significant vacant or underutilized industrial sites, recommend truck route designations and restrictions, and recommendations for capital improvements;

WHEREAS, this grant requires local match of $56,000.00, which is funded by 11300.1500.520380

WHEREAS, Cook County applied to the Illinois Department of Transportation (IDOT) for Statewide Planning and Research Program monies and was awarded $390,000.00for a planning study to investigate ways to improve transit service for all users of public transportation within Cook County by considering changes to fare structure, new sources of financing, changes to existing services, and the costs and

WHEREAS, this grant requires local match of $97,500.00, which is funded by 11300.1500.520380 P24193 A10846 and the funding period is 10/1/18 through 9/30/21; and

NOW, THEREFORE, BE IT RESOLVED, that the President of the Board of Commissioners of Cook County and/or her designee, the Superintendent of the Department of Transportation and Highways (DOTH), is hereby authorized to execute such documents as required to accept the sum of Three Hundred Ninety Thousand and NO/100dollars ($390,000.00) from the Illinois Department of Transportation’s Statewide Planning and Research Program for professional services necessary to complete this planning study; and

WHEREAS, Cook County is willing to act as the lead agent for roadway improvements along 131st Street and is an eligible applicant for funding from the Illinois Department of Transportation (IDOT); and

WHEREAS, Cook County, on behalf of the Village of Alsip, applied to IDOT for Economic Development

Program monies and was awarded $2,000,000 for roadway engineering and construction; and

WHEREAS, this grant requires local match of $150,000.00, which is funded by 11300.1500.540370 P21020 A10134, and the grant funding starts April 25, 2019; and

NOW, THEREFORE, BE IT RESOLVED, that the President of the Board of Commissioners of Cook County and/or her designee, the Superintendent of the Department of Transportation and Highways (DOTH), is hereby authorized to execute such documents as required to accept the sum of Two Million and NO/100dollars ($2,000,000.00) from the Illinois Department of Transportation’s Economic Development Program for the Phase II engineering, construction, and construction management of this improvement; and

BE IT FURTHER RESOLVED, that this Grant Award shall be used by the Department of Transportation and Highways for roadway improvements for 131st Street where the scope of work shall include the reconstruction of existing pavement to concrete pavement, drainage improvements, and other necessary highway appurtenances and shall be designated as Section: 15-13129-01-FP; and
