City of Harvey City Council met Aug. 26.

The regular meeting of the Harvey City Council was called to order at 7:16 p.m. by Mayor Christopher J. Clark.
ROLL CALL:
Mayor Clark asked City Clerk Arambula to call of roll Council members. Present were Alderwoman Shirley Drewenski, Aldermen Marshun Tolbert, Quinton Crudup, Tracy Key, Randle-El, Tyrone Rogers and Mayor Christopher Clark.
Melville King Jr. gave the invocation and Mayor Clark led the Pledge of Allegiance.
PUBLIC COMMENT:
Mayor Clark announced that public comments will be limited to 3 minutes: #1 - Ms. Jerlene Harris commented about the problems she is having with the Water Department and that it has caused damage to meter at her home and mole.
#2 – Mr. Melville King commended the Harvey Police and Fire Departments. We need to come together and report about vacant properties being vandalized.
#3 - Ms. Ruby Donahue commended the elected officials about togetherness.
#4 – Mr. Rameriz congratulated the newly elected officials. He commented about dumping behind his dads home.
#5 – Mr. Joshua Riggins commented that someone dumped truck load of wood in the field back of his property and there is an abandon car the weeds are so high.
#6 – Ms. Arleta Bolton announced the 34th Annual Back to School Parade will be on Saturday - September 14, 2019 and invited the Mayor and Elected Officials to be the Grand Marshalls.
AMEND THE AGENDA:
Alderman Randle - El made a motion to amend the agenda and add under New Business: item C. Override the Mayor Veto (Taft Law Firm). The motion was second by Alderman Rogers.
Voting aye were Aldermen Rogers, Key, Crudup, Alderwoman Drewenski and Tolbert.

NEW BUSINESS:
APPROVAL OF THE MINUTES:
Moved by Alderman Randle -El to approve the Minutes dated August 12, 2109. The motion was second by Alderman Key.
Voting Aye were Alderwoman Drewenski, Aldermen Key, Crudup, Randle -El, Rogers and Tolbert.

CITY TREASURER REPORT:
City Treasurer Aisha Pickett gave a verbal report of the City finances, cash balances, cash receipts and disbursements. She also addressed the council, staff and residents * Please see attached treasurer statement.
OVERTURN THE MAYOR'S VETO:
Alderman Randel-El made the motion to overturn the Mayor veto. The motion was second by Alderman Rogers.
Voting Aye were Aldermen Randle-El, Key and Rogers Voting Nay were Aldermen Crudup and Alderwoman Drewenski Alderman Tolbert - Abstained

Mayor Clark called for a 10 minute recess to allow Corporation Counsel Krafthefer research of the vote.

Mayor Clark asked City Clerk Arambula to call the roll: present were Alderwoman Drewenski, Aldermen Crudup, Key, Tolbert, Randle -El, Rogers and Mayor Clark.
Mayor Clark asked Counsel if she has that information ?
Corporation Counsel Krafthefer: I do, in section 3.1-40-50 of the Illinois Municipal code 65 ILCS 5/3.1-40-50 it says if after reconsideration 2/3 of all the Aldermen then holding office on City Council agree at the regular meeting to pass an ordinance, resolution or motion notwithstanding the Mayor's refusal to approve it, then it shall be effective.
The vote on question on the passage over the Mayor's veto shall recorded by aye or nays and shall be recorded in the journal.
Alderman Rogers asked Counsel does that ordinance apply throughout every City and State in Illinois?
Corporation Counsel this section does not apply for populations over 500,000.
OLD BUSINESS:
Ordinance # 3381- An ordinance amending Chapter 8 -32 of the municipal code of Harvey concerning unsecure buildings, vacant properties, foreclosed properties and rental properties.
Alderman Tolbert made the motion that Council approve Ordinance # 3381. The motion was second by Alderman Randle -El.
Voting Aye were Aldermen Crudup, Rogers, Tolbert, Key, Randle-El, and Alderwoman Drewenski.
MOTION CARRIED
Ordinance # 3383 -An ordinance amending Title 6 of the Municipal Code of Harvey Regulating animals and pets and establishing regulations regarding the same.
Alderman Tolbert motioned that Ordinance #3383 will remain in committee we are waiting updated language that was to be taken out and corrected.

PETITIONS AND COMMUNICATIONS:
Mayor Clark read aloud each petition and communications.
Moved by Alderman Randle-El that we strike item d and take items a-c in an omnibus vote. The motion was second by Alderwoman Drewenski.
Voting Aye were Alderwoman Drewenski, Aldermen Tolbert, Crudup, Key, Randle-El and Rogers.

Mayor Clark I need a motion to approve consent items.
Moved by Alderman Tolbert to approve the consent items a-c. The motion was second by
Alderwoman Drewenski.
Voting Aye were Aldermen Crudup, Rogers, Tolbert, Key, Randle-El and Alderwoman Oman

Mayor Clark called for a motion to go into executive session to discuss pending litigations.
EXECUTIVE SESSION: Time 8:32 P.M.
Moved by Alderman Rogers to go into executive session. The motion was second by Alderwoman Drewenski.
Voting Aye were Aldermen Crudup, Key, Alderwoman Drewenski, Aldermen Rogers Randle-El and Tolbert.

RECONVENE FROM EXECUTIVE SESSION: Time 8:51 P.M.
Moved by Alderman Rogers to take items a-c in an omnibus vote. The motion was second by Alderwoman Drewenski.

Moved by Alderwoman Drewenski to approve settlement as discussed in executive session. The motion was second by Alderman Rogers.
