City of Palos Hills City Council met Sept. 19.

Here is the minutes provided by the council:

1) CALL TO ORDER: Mayor Bennett called the City Council Meeting to order at 7:00p.m.

2) PLEDGE TO THE FLAG: Mayor Bennett led everyone in the Pledge to the Flag.

3) ROLL CALL: Upon roll call the following Aldermen responded:

PRESENT: Price, Brachman, Lebarre, Marrotta, O’Connell, Kleefisch, Stratton, Pasek, Nowak

ABSENT: Moore

4) QUORUM: Mayor Bennett declared a quorum was present.

5) READING OF THE PREVIOUS MEETING MINUTES:

Ald. Kleefisch MOVED to approve the City Council Meeting Minutes dated, September 5, 2019 as presented. SECONDED by Ald. Nowak. Upon roll call the following Ald. voted:

AYE: Brachman, Lebarre, O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price

NAY: None

ABSENT: Moore

ABSTAIN: Marrotta 

MOTION CARRIED

6) CITIZENS PETITION: None

7) CITIZENS HEARING:

Mayor Bennett, the meeting is open to the public for any comments or questions.

Richard Stachon, of 8557 Sun Valley Drive, addressed the Council about widening his driveway.

Mayor Bennett advised that Council had already spent a lot of time on this resulting in two or three meetings; council had come to a conclusion as to what they believe Mr. Stachon should have and he is now coming back with modifications. Mayor Bennett stated that Council had already made a decision and he is now requesting a revision. As such, he is going to allow City Council to take time and discuss this proposal. Mr. Stachon will have an updated survey for review at the next meeting in two weeks.

Ald. Kleefisch asked Mr. Stachon if he had already removed all of the lawn where he wants to widen the driveway. Mr. Stachon stated ‘yes’.

Edward Gal, the owner of At Home Realty Group at 8632 W. 103rd Street, addressed council to get an idea as to where Palos Hills stands on the subject surrounding recreational marijuana, as he and a group from Colorado were planning on opening recreational marijuana dispensaries.

Mayor Bennett advised that there was an extensive discussion two weeks ago and council is still in discussion mode.

There were no other comments or questions from the public; the public portion of the meeting was closed.

8) REPORTS & COMMUNICATIONS FROM MAYOR AND OTHER CITY OFFICIALS:

A. CITY CLERK: None this evening.

B. CITYATTORNEY:

I. City Attorney Pappas drafted two ordinances one regarding the lot split, and one for the amendment of a building code. City Attorney Papas provided an update on the Valley Plaza lawsuit, they’re going to repair the furthest fence to the north and they are going to pay the amount for the stump removal. City Attorney Pappas requested approval to settle on the agreement that they came upon so that it can be presented to Judge Hines.

Mayor Bennett entertained a motion to grant City Attorney Pappas permission to settle as agreed upon. SO MOVED by Ald. Brachman. SECONDED by Ald. Pasek. Upon roll call the following Ald. Voted:

AYE: Lebarre, Marrotta, O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price, Brachman 

NAY: None

ABSENT: Moore 

MOTION CARRIED

Ald. Stratton asked City Attorney Pappas for an update on the case with 10505 South 82nd Court. City Attorney Pappas stated that the case is scheduled for total attempt in front of Judge Hines. Judge continued to give an opportunity to demolish that building (inaudible)

C. MAYOR:

I. The 2019 Beautification Awards were presented by Ald. Kleefisch. Mayor Bennett thanked Ald. Kleefisch for starting the Beautification program 16 years ago. Mayor Bennett and Alderman Kleefisch presented the following winning residents of the Beautification Award Contest with a certificate and yard sign:

II. Mayor Bennett announced that Hickory Willow Swim Association has approached the City again this year for a Raffle License along with an extension for selling the raffle tickets from 90 to 120 days. SO MOVED by Ald. Stratton. SECONDED by Ald. Lebarre. Upon roll call the following Ald. voted:

AYE: Marrotta, O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price, Brachman, Lebarre NAY: None

III. Mayor Bennett announced that Hills Hellhounds baseball association has requested to utilize the Palos Hills Golf Clubhouse waive the fee for the rental of the clubhouse on October 6th from 10:30 a.m. to Noon. Golf course will still be open. SO MOVED by Ald. Stratton. SECONDED by Ald. Marrotta. Upon roll call the following Ald. voted:

AYE: O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price, Brachman, Lebarre, Marrotta 

NAY: None

9) PRESENTATION OF PETITIONS, COMMUNICATIONS, RESOLUTIONS, AND ORDINANCES BY ALDERMEN:

A. BUILDING&LICENSING:

Ald. Price had no report this evening.

B. CITYADMINISTRATION/GOLF:

In the absence of Ald. Moore there was no report this evening.

C. COMMUNITYRESOURCES:

Ald. Nowak reported that the City of Palos Hills will be offering a shred day on Saturday, September 28th from 9:00 to 11:00 a.m. at the Palos Hills Community Center. This event is hosted by AT & T, State Representative Kelly Burke and State Senator Bill Cunningham.

The department will also be hosting a Chicago Lighthouse Low Vision Products Show for those who are blind or visually impaired on Tuesday, October 8th from 10:00 a.m. to 3:00 p.m. Please note this is a drop in program. It does not last all day. For more information about these programs, please call the Palos Hills Community Center at 430-4500.

D. ECONOMICDEVELOPMENT:

Ald. O’Connell announced that Folk Tybycik, Co. at 10554 S. Roberts Road has submitted all necessary paperwork and have been granted their business license. They are a clothing, specializing in Folklore outfits.

E. FINANCE:

Ald. Lebarre MOVED to authorize the expenditure of a Vendor Warrant dated, September 19, 2019 in the amount of $349,757.46. SECONDED by Ald. Brachman. Upon roll call the following Ald. voted:

AYE: Kleefisch, Stratton, Pasek, Nowak, Price, Brachman, Lebarre, Marrotta, O’Connell 

NAY: None

ABSENT: Moore

F. LEGISLATION & ORDINANCES:

Ald. Marrotta mentioned the memo he received from the Ordinance Officer in regards to property maintenance required at 10250 S. 81st Court. Ald. Marrotta MOVED to have City Attorney Pappas send a letter regarding property maintenance including exterior maintenance, removal of all excess items, debris, and junk vehicles. SECONDED by Ald. Brachman. Upon roll call the following Ald. voted:

AYE: Stratton, Pasek, Nowak, Price, Brachman, Lebarre, Marrotta, O’Connell, Kleefisch 

NAY: None

Ald. Kleefisch questioned Section 2C where the permit applicant is allowed 90 days to begin their project after being issued the permit.

Commissioner Hardison responded that the 90 days is based upon International Building Code.

After the reading of proposed Ordinance number 2019-14 entitled An Ordinance Providing For Residential Parking Signs Along 80th Court, North of 107th Street. Ald. Kleefisch MOVED for its PASSAGE of same. SECONDED by Ald. Price. Upon roll call the following Ald. voted:

AYE: Price, Brachman, Lebarre, Marrotta, O’Connell, Kleefisch, Pasek, Nowak 

NAY: None

G. PARKS:

Ald. Stratton, announced that the Recreation Department will be hosting a Fall Fest on Friday, October 18, from 6:30-9:00 p.m. at the Palos Hills Community Center. The night will feature entertainment, crafts, games and food. For more information, please call the Community Center at 708-430-4500.

H. PLANNING&ZONING:

Ald. Nowak, everyone has before them the Plan Commission minutes from the meeting on August 26th. I MOVE for City Attorney Pappas to draw a special use ordinance for the daycare located at 8100-8066 W. 111th Street. SECONDED by Ald. O’Connell. Upon roll call the following Ald. voted:

AYE: Brachman, Lebarre, Marrotta, O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price 

NAY: None

ABSENT: Moore

I. PUBLIC SAFETY:

Ald. Kleefisch, presented and read the Palos Hills Police Department Activity Report for the month of August 2019 as follows: 224 traffic tickets were issued, 277 parking tickets, there were 16 misdemeanor complaints and 1 felony complaint, there were 2 burglaries, 5 thefts, and our C.I.D. Division handled a total of 140 cases.

Ald. Kleefisch, MOVED to request 25 feet variance at Green Hills Public Library entrance on the north side of Interlochen Drive, and also to draft the necessary ordinance. SECONDED by Ald. Stratton. Upon roll call the following Ald. voted:

AYE: Lebarre, Marrotta, O’Connell, Kleefisch, Stratton, Pasek, Nowak, Price, Brachman 

NAY: None

ABSENT: Moore

J. PUBLIC WORKS/SEWER & WATER:

Ald. Brachman had no report this evening.

10) REPORTS OF SPECIAL COMMITTEES: No report this evening.

11) UNFINISHED BUSINESS: Ald. Nowak addressed City Attorney Pappas to clarify if Valley Plaza are paying the tickets that were issued as well. City Attorney Pappas replied that they are not.

12) MISCELLANEOUS BUSINESS: None this evening.

13) ADJORNMENT:

No further business, Mayor Bennett entertained a motion to adjourn. SO MOVED by Ald. Stratton. SECONDED by Ald. Pasek. By voice vote, all voted AYE.

The Meeting adjourned at 8:22 p.m.
