City of Palos Hills City Council met Jan. 16.

Here is the minutes provided by the council:

1) CALL TO ORDER: Mayor Bennett called the City Council Meeting to order at 7:00p.m.

2) PLEDGE TO THE FLAG: Mayor Bennett led everyone in the Pledge to the Flag.

3) ROLL CALL: Upon roll call the following Aldermen responded:

PRESENT: Brachman, Lebarre, O’Connell, Kleefisch, Stratton, Pasek, Moore, Nowak 

ABSENT: Price, Marrotta

4) QUORUM: Mayor Bennett declared a quorum was present.

5) READING OF THE PREVIOUS MEETING MINUTES:

Ald. Kleefisch MOVED to approve the City Council Meeting Minutes dated, January 2, 2020 as presented. SECONDED by Ald. Moore. Upon roll call the following Ald. voted: 

AYE: Brachman, O’Connell, Kleefisch, Stratton, Pasek, Moore, Nowak 

NAY: None 

ABSTAIN: Lebarre 

ABSENT: Marrotta, Price 

MOTION CARRIED

6) CITIZENS PETITION: None this evening

7) CITIZENS HEARING:

Mayor Bennett, the meeting is open to the public for any comments or questions.

There were no comments or questions from the public; the public portion of the meeting was closed.

8) REPORTS & COMMUNICATIONS FROM MAYOR AND OTHER CITY OFFICIALS:

A. CITY CLERK: No report this evening.

B. CITY ATTORNEY: City Attorney Pappas provided updates as follows:

o Demolition action has been filed against the house on Meryton Court, with a scheduled

court date of February 6th. o Demolition order for 10505 S. 82nd Court was signed yesterday by Judge Burke. The building Commissioner has received a response from the owner of the property who states they are going to try and do something, but City Attorney Pappas doesn’t anticipate much action. City Attorney Pappas will go in front of Judge Burke in 60days and she will allow us to demolish. We allowed the 60 days to give the bank and the owner the opportunities to demolish so the City didn’t have to incur the cost. o 3 cent per gallon gas tax ordinance is on the agenda for tonight and the date for enforcement is July 1, 2020.

C. MAYOR: Mayor Bennett announced that April 1st is the 2020 Census. It is critical as it is only done every ten years; therefore every person needs to be counted. We will begin reminding our residents to participate through the water billing process.

Mayor Bennett stated that the bi-annual expo put on by the Southwest Conference of Mayors will be held on March 14, 2020 in Palos Hills at the Belvedere Chateau and encouraged all the members of City Council and Department heads to sign up and attend the event.

9) PRESENTATION OF PETITIONS, COMMUNICATIONS, RESOLUTIONS, AND ORDINANCES BY ALDERMEN: A. BUILDING & LICENSING:

In the absence of Ald. Price there was no report this evening.

B. CITY ADMINISTRATION/GOLF:

Ald. Moore, stated that there will be a Golf meeting on February 20, 2020 at 5:00 p.m. held at City Hall. Ald. Moore asked City Attorney Pappas if he has looked at the ordinance regarding recreational vehicles and come back with recommended verbiage for amendment.

City Attorney Pappas stated he has some ideas, and requested that it be up for discussion at the next Committee of the Whole meeting on February 6, 2020.

Ald. Moore stated that we should strike the 12,000 pounds in the ordinance and if you have a recreational vehicle, it needs to fit and be stored in your garage.

City Attorney Pappas mentioned to limit the size of the recreational vehicles that are parked at single family residences, and if it’s over that size possibly require them to park it at a private industrial or manufacturing area.

Ald. Moore agreed to revisit this discussion at the February 6, 2020 Committee of the Whole meeting.

C. COMMUNITY RESOURCES:

Ald. Nowak, the Community Resource and Recreation Department is offering puppy and dog training classes beginning on Wednesday, February 19, 2020. They are also offering an introduction to dog therapy training class as well. For more detailed information or to register please call the Community Resource and Recreation Department at 708-430-4500.

D. ECONOMIC DEVELOPMENT:

Ald. O’Connell, announced that two new businesses Home Therapeutic Staffing and Beauty Line Center Inc. have submitted all necessary paperwork and have been issued their business licenses.

E. FINANCE:

Ald. Lebarre MOVED to authorize the expenditure of a Vendor Warrant dated, January 16, 2020 in the amount of $365,351.05. SECONDED by Ald. Brachman. Upon roll call the following Ald. voted:

AYE: Lebarre, O’Connell, Kleefisch, Stratton, Pasek, Moore, Nowak, Brachman

NAY: None 

ABSENT: Marrotta, Price 

MOTION CARRIED

F. LEGISLATION & ORDINANCES:

In the absence of Ald. Marrotta, Ald. Moore MOVED to increase the Class C-2 liquor license cafes by one. SECONDED by Ald. Stratton. Upon roll call the following Ald. voted:

AYE: Stratton, Pasek, Moore, O’Connell 

NAY: Kleefisch, Nowak, Brachman, Lebarre 

ABSENT: Price, Marrotta

With a tie on votes, Mayor Bennett voted AYE

G. PARKS:

Ald. Stratton, the City has been informed that we are eligible for a grant to create a new trail in town through the Illinois Department of Natural Resources in cooperation with the Federal Highway Administration. Mayor Bennett along with Commissioners Oeffling and Violante believe a trail at the Nineteen Acres site extended from Bennett Park and Public Works facility across the street would make a great grant project. I would like to schedule a public meeting to discuss this project with residents on Thursday, January 30, 2020 at 6:00 p.m. at City Hall.

Mayor Bennett stated it would be a trail that would extend across the street from Bennett Park into Nineteen Acres, but the suggestion is to make a walking path which would connect up to Moraine Valley College and extend through their property into their full trail around the campus. This trail would lead to a public walkway on Palos Drive and the sidewalk along 107th Street; it’s a simple project estimated cost is around $40,000.00. The grant was for seventy percent of that. It would extend an opportunity for us to create a walking trail from the Golf Course to Moraine Valley Community College. By regulation we have to have a public hearing on it before we would submit for the grant which is due on or about March 2, 2020. The meeting will be at 6:00 p.m. on Thursday, January 30, 2020.

H. PLANNING & ZONING:

Ald. Nowak, MOVED to set the Zoning Board of Appeals meeting for a variance for a new residence at 10502 S. 82nd Avenue for Tuesday, February 11, 2020 at 7:00 p.m. SECONDED by Ald. O’Connell. Upon roll call the following Ald. voted:

AYE: O’Connell, Kleefisch, Stratton, Pasek, Moore, Nowak, Brachman, Lebarre 

NAY: None 

ABSENT: Marrotta, Price 

MOTION CARRIED

Ald. Nowak stated that everyone should have the Plan Commission hearing minutes that was held on December 9, 2019 regarding the vehicle storage and repair facility known as Alpha Carrier Experts Incorporated.

Ald. Nowak addressed Commissioner Hardison regarding number 3, where it states “vehicles must be in ‘X’ condition”, asking him to clarify the meaning. Commissioner Hardison replied stating it would be referring to the condition of the vehicles that are going to be on the property.

Emad Haleem stated that they’re a licensed relocate company meaning if a vehicle is parked in a location that it shouldn’t be, they will be towing the vehicle and it will need to be picked up from Alpha Carrier Experts.

Commissioner Hardison confirmed with Mr. Haleem that there will be no junk vehicles or become a scrapyard.

Ald. Stratton raised a question regarding the Plan Commission minutes on page 12, where Commissioner Kladis stated they have gone by the Ashland property and have mentioned it looks like a junkyard and there is a concern that the property in Palos Hills will look the same way.

Mr. Haleem stated it was rectified with Commissioner Hardison as the pictures taken were of the wrong property.

Ald. Nowak MOVED to approve the positive recommendation of the Plan Commission and to have City Attorney Pappas draw a special use ordinance for Alpha Carrier Experts. SECONDED by Ald. Moore. Upon roll call the following Ald. voted:

AYE: O’Connell, Kleefisch, Stratton, Pasek, Moore, Nowak, Brachman, Lebarre 

NAY: None

ABSENT: Price, Marrotta

I. PUBLIC SAFETY:

Ald. Kleefisch, presented and read the Palos Hills Police Department Activity Report for the month of December 2019 as follows: 199 traffic tickets were issued, 260 parking tickets, there were 14 misdemeanor complaints and no felony complaints, there were no criminal homicides, no robberies, 1 aggravated assault/battery, no burglaries, 7 thefts, no motor vehicle thefts, and our CID division handled a total of 65 cases.

Ald. Kleefisch stated that we received a check for registration fees in the amount of $455.00.

J. PUBLIC WORKS/SEWER & WATER:

Ald. Brachman, announced the update for the 2020 water rate as follows:

The Village of Oak Lawn set their water rate on January 1, 2020 using their own formula, and the City of Chicago will be adjusting their water rate in June 2020. Over the last several years Chicago has used the Consumer Price Index.

In accordance with Chapter 13.23.010 Rate Increases – the Commissioner of Water and Sewer has increased the City of Palos Hills water rate effective January 1, 2020. The new water rate will offset the cost of water, delivery, maintenance and operation of the city water system.

The 2020 / 2021 water rate will be $10.45 per 1000 gallons delivered. The old water rate was $10.15 per 1000 gallons delivered. This represents an increase of $0.30 per 1000 gallons delivered.

The 2020/21 minimum water bill will be as follows: $41.80 for the first 4000 gallons $11.50 for sanitary sewer service $12.92 for general capital improvement Total $66.22 monthly minimum

This represents an increase of $1.20 to the minimum monthly bill which includes a 4,000 gallon monthly minimum purchase.

Upon request of Ald. Brachman, City Clerk Mulderink assigned Resolution number 638 to A Resolution Adopting A Complete Streets Policy.

After the reading of Resolution 638, Ald. Brachman MOVED for ADOPTION of same. SECONDED by Ald. O’Connell. Upon roll call the following Ald. voted:

AYE: Pasek, Moore, Nowak, Brachman, Lebarre, O’Connell, Kleefisch, Stratton 

NAY: None 

ABSENT: Price, Marrotta

Ald. Brachman MOVED for consideration of An Ordinance Amending Title 3 By Adding Chapter 3.23 To The Palos Hills Municipal Code. SECONDED by Ald. Lebarre. Upon roll call the following Ald. voted:

AYE: Moore, Nowak, Brachman, Lebarre, O’Connell 

NAY: Kleefisch, Stratton, Pasek 

ABSENT: Price, Marrotta

City Clerk Mulderink assigned number 2020-1 to that proposed Ordinance.

After the reading of proposed Ordinance 2020-1 entitled An Ordinance Amending Title 3 By Adding Chapter 3.23 To The Palos Hills Municipal Code Ald. Brachman MOVED for its PASSAGE of same. SECONDED by Ald. Lebarre. Upon roll call the following Ald. voted:

AYE: Nowak, Brachman, Lebarre, O’Connell, Moore 

NAY: Kleefisch, Stratton, Pasek 

ABSENT: Price, Marrotta 

MOTION CARRIED

10)REPORTS OF SPECIAL COMMITTEES: None this evening.

11) UNFINISHED BUSINESS: Ald. Moore asked for the Administrative Manager to remind Mike and Marty that on February 20, 2020 at 5:00 p.m. there will be a Golf meeting.

City Attorney Pappas requested for a Legislation and Ordinance meeting February 6, 2020 at 6:00 p.m. to discuss the recreational vehicle concerns.

12) MISCELLANEOUS BUSINESS: Mayor Bennett announced that on Thursday, February 13, 2020 at 5:30 p.m. there will be a screening at City Hall of All the Queen’s Horses, courtesy of IML, exclusive to public officials.

Ald. Moore stated that the Golf meeting scheduled for February 20, 2020 will now be held at 5:30 p.m.

13) ADJORNMENT:

No further business, Mayor Bennett entertained a motion to adjourn. SO MOVED by Ald.Stratton. SECONDED by Ald.Pasek. By voice vote, all voted AYE.

The Meeting adjourned at 7:35 p.m.
