The regular meeting of the Board of Trustees, Village of Tinley Park, Illinois, was held in the Council Chambers located in the Village Hall of Tinley Park, 16250 S. Oak Park Avenue, Tinley Park, IL on July 16, 2024. President Glotz called this meeting to order at 6:16 p.m. 

At this time Trustee Brady led a prayer for unity in our country. 

Clerk O'Connor called the roll. Present and responding to roll call were the following:

A PUBLIC HEARING HELD ON JULY 16, 2024, BEFORE THE CORPORATE AUTHORITIES OF THE VILLAGE OF TINLEY PARK, COOK AND WILL COUNTIES, ILLINOIS, THE ANNEXATION OF CERTAIN PROPERTY AT 18301 WHITE EAGLE DRIVE PURSUANT TO 65 ILCS 5/7-1-13 (WLS RADIO TOWER). 

Motion was made by Trustee Mahoney, and seconded by Trustee Shaw, to open the Public Hearing on the ANNEXATION OF CERTAIN PROPERTY AT 18301 WHITE EAGLE DRIVE PURSUANT TO 65 ILCS 5/7-1-13 (WLS RADIO TOWER). 

At this time Trustee Mahoney presented an overview of the Village of Tinley Park's proposal to annex the property at 18301 White Eagle Drive, currently housing a radio tower for WLS-AM 890, under the allowances of the Illinois Municipal Code (65 ILCS 5/7-1-13). 

Receive comments from the public. No one came forward. 

Motion was made by Trustee Mahoney seconded by Trustee Shaw to close the Public Hearing. Vote by roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried and closed the Public Hearing. 

Motion was made by Trustee Brennan, seconded by Trustee Mueller to approve the agenda as written or amended for this meeting. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Sullivan, seconded by Trustee Shaw to approve and place on file the minutes of the regular Village Board Meeting held on June 18, 2024. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Brennan, seconded by Trustee Brady to adopt a proclamation RECOGNIZING TINLEY PARK POLICE OFFICERS ROBERTO FRIAS AND ANTHONY LEFKO FOR LIFE-SAVING ACTIONS. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Brady, seconded by Trustee Brennan to proclaim TUESDAY, AUGUST 6, 2024, AS THE 41ST ANNUAL "NATIONAL NIGHT OUT" IN THE VILLAGE OF TINLEY PARK. National Night Out is an annual community-building campaign that promotes police-community partnerships and neighborhood camaraderie. This is the 41st year that the Village of Tinley Park has participated in this national event. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Mueller, seconded by Trustee Mahoney to proclaim AUGUST 4 - 10, 2024, AS NATIONAL FARMERS MARKET WEEK IN THE VILLAGE OF TINLEY PARK. National Farmers Market Week highlights the vital role farmers markets play in our nation's food system. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried.

Motion was made by Trustee Mueller, seconded by Trustee Mahoney to appoint LEGAL COUNSEL FOR THE VILLAGE OF TINLEY PARK 2024 BOND ISSUE. The Village Board appointed legal counsel of Sheppard, Mullin, Richter & Hampton LLP, for the Village of Tinley Park 2024 Bond Issue. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. 

Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Shaw, seconded by Trustee Sullivan to consider approving the following Consent Agenda items: 

A. ADOPT RESOLUTION 2024-R-079 APPROVING AN AGREEMENT BETWEEN THE VILLAGE OF TINLEY PARK AND TRIA ARCHITECTURE, INC. FOR HARMONY SQUARE PROFESSIONAL SERVICES - FURNITURE DESIGN IN THE AMOUNT OF $39,850. 

B. ADOPT RESOLUTION 2024-R-085 FOR A BLANKET PURCHASE ORDER FOR ROMEOVILLE FIRE ACADEMY IN THE AMOUNT OF $40,000 FOR TRAINING AND ACADEMY CLASSES. 

C. ADOPT RESOLUTION 2024-R-086 FOR A BLANKET PURCHASE ORDER FOR EAGLE UNIFORM IN THE AMOUNT OF $40,000 FOR THE PURCHASE OF UNIFORM ITEMS. 

D. APPROVAL OF REQUEST FROM GIGI'S PLAYHOUSE TINLEY PARK TO CONDUCT A RAFFLE THROUGH FRIDAY, OCTOBER 25, 2024, WITH THE WINNER BEING DRAWN THAT DAY, AT TUSCANY FALLS BANQUETS, 9425 191ST STREET. THE MAXIMUM VALUE OF THE PRIZE NOT TO EXCEED $15,000. 

E. PAYMENTS OF OUTSTANDING BILLS IN THE AMOUNT OF $7,152,501.21 AS LISTED ON THE VENDOR BOARD APPROVAL REPORTS DATED JUNE 21 AND 28, AND JULY 5 AND 12, 2024.

Motion was made by Trustee Mahoney, seconded by Trustee Brennan to adopt and place on file ORDINANCE 2024-O-036 ANNEXING THE PROPERTY AT 18301 WHITE EAGLE DRIVE, PURSUANT TO 65 ILCS 5/7-1-13 (WLS RADIO TOWER). The parcel will be annexed under the R-1 Zoning District. The annexation will be effective on the date of passage. This item was discussed at the Committee of Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Motion was made by Trustee Mahoney, seconded by Trustee Brennan to adopt and place on file ORDINANCE 2024-O-037 GRANTING A SPECIAL USE FOR A SUBSTANTIAL DEVIATION TO THE PARK PLACE PUD WITH EXCEPTIONS FOR CONSTRUCTION OF A DRIVE-THRU RESTAURANT LOCATED AT 16210 HARLEM AVENUE (CHICK-FIL-A). The request allows the development of a Chick-fil-A drive-thru restaurant at an outlot parcel located at 16210 Harlem Avenue in the B-3 PD zoning district. The Plan Commission held a Public Hearing on June 20, 2024, and voted 8-0 to recommend approval of the Special Use in accordance with the plans, recommended conditions, exceptions, and Findings of Fact listed in the Staff Report. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Motion was made by Trustee Mahoney, seconded by Trustee Sullivan to adopt and place on file RESOLUTION 2024-R-080 APPROVING A CONTRACT BETWEEN THE VILLAGE OF TINLEY PARK AND ECO LIGHTING SERVICES AND TECHNOLOGY LLC FOR THE REPLACEMENT OF INTERIOR LIGHTING AT OAK PARK AVENUE TRAIN STATION. The contract amount shall not exceed $117,790. This item was discussed at the Committee of Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Motion was made by Trustee Sullivan, seconded by Trustee Mahoney to adopt and place on file ORDINANCE 2024-O-038 AMENDING TABLE XI, SECTION I-XI-II RELATED TO SPECIAL EVENT PERMIT FEES IN THE VILLAGE OF TINLEY PARK. This Ordinance amends Table XI, Section I-XI-II related to special event permit fees. This item was discussed at the Committee of the Whole held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Motion was made by Trustee Shaw, seconded by Trustee Mueller to adopt and place on file RESOLUTION 2024-R-084 APPROVING AN AGREEMENT BETWEEN THE VILLAGE OF TINLEY PARK AND ROBERT W. BAIRD & CO. INCORPORATED FOR MUNICIPAL ADVISORY SERVICES. This agreement re-affirms Baird & Co. to provide municipal advisory services for the Village of Tinley Park 2024 Bond Issue. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Motion was made by Trustee Brennan, seconded by Trustee Sullivan to adopt and place on file ORDINANCE 2024-O-039 OPTING OUT OF THE ILLINOIS MUNICIPAL CODE'S POLICE OFFICER APPLICANT AGE RESTRICTION. This Ordinance opts the Village out of the Illinois Civil Service statute as it relates to the hiring age of Officers. Instead, the Village will set age limits under Home Rule Authority. President Glotz asked if there were any comments from members of the Board or public. It was stated that the age requirements are 21 to 39 years. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

Motion was made by Trustee Brennan, seconded by Trustee Mueller to adopt and place on file ORDINANCE 2024-O-040 AMENDING THE RULES AND REGULATIONS FOR THE VILLAGE OF TINLEY PARK CIVIL SERVICE COMMISSION. Upon opting out of the Civil Service State statue requirements, the Village's Civil Service Rules and Regulations need to be amended to reflect this change. The age requirement would shift from 34 to 39 years old for lateral hires only. Entry level Patrol Officers would still fall under the existing age requirement of 34. Motion was made by Trustee Brennan, seconded by Trustee Sullivan to adopt and place on file RESOLUTION 2024-R-087 FOR A BLANKET PURCHASE ORDER REQUESTED WITH AIR ONE FOR THE PURCHASE OF BUNKER GEAR. This resolution approves the blanket purchase order requested with Air One in the amount of $100,000 for the purchase of bunker gear needed to keep the Fire Department members properly outfitted for their jobs. Air One is the sole source provider for Globe products and is the only authorized MSA Fire Service Distributor in the Chicago Metropolitan area.

Motion was made by Trustee Mueller, seconded by Trustee Mahoney to adopt and place on file RESOLUTION 2024-R-081 APPROVING A CONTRACT BETWEEN THE VILLAGE OF TINLEY PARK AND SEWER ASSESSMENT SERVICES, LLC FOR INFLOW AND INFILTRATION (I/I) INVESTIGATIONS. Consider approving a contract with Sewer Assessment Services, LLC in the amount of $134,612.68. This item was discussed at the Committee of the Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. 

Public Works Director, John Urbanski, explained this is an ongoing testing process that is followed by the Village to comply with the Metropolitan Water Reclamation Districts (MWRD) watershed ordinance. He also presented an overview of the flooding and contaminated water issues at the former mental health center property (now owned by the Tinley Park Park District) that has affected the Village water systems. He referred to a complaint filed with the Illinois Environmental Protection Agency (IEPA) by the Tinley Park Park District's Project Manager concerning the former mental health center property. The final report filed by the Illinois Environmental Protection Agency (IEPA) cleared the Village of any wrongdoing. Because of issues on the property, the Village had problems with its sanitary line and installed a valve halting the outflow from the property which was being inundated by stormwater. After an investigation, the complaint was discovered to be unfounded, and the Village did what was necessary to protect its citizens and its water system. 

President Glotz stated concerns about the complaint filed. 

Village Attorney Del Galdo explained that if the Village were to receive the water from the Park District's property, untreated water would flow directly into the freshwater through MWRD systems. This would violate EPA, MWRD, and its fiduciary obligations to the public. Repercussions could include injunctions, violation of State and County ordinances, sues, and fines. 

Clerk O'Connor stated she has had discussions with the U.S. EPA and the IEPA regarding flooding on the property. She referred to contamination on the property that has entered the water. 

Trustee Shaw commended the Village for acting in the best interest of the community. 

Public Works Director Urbanski explained how the Village's investigation of issues with the sanitary lines began.

Motion was made by Trustee Mueller, seconded by Trustee Sullivan to adopt and place on file RESOLUTION 2024-R-082 APPROVING A CONTRACT BETWEEN THE VILLAGE OF TINLEY PARK AND CHRISTOPHER B. BURKE ENGINEERING, LTD. FOR THE WATER MAIN REPLACEMENT PROGRAM - DESIGN ENGINEERING SERVICES. This contract with Christopher B. Burke Engineering, LTD. is in the amount of $301,330. This item was discussed at the Committee of the Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried.

FOR BID PACKAGE #2-13 HARMONY SQUARE - WATER FEATURE. This contract with Laughing Waters, Inc. is in the amount of $876,434. This item was discussed at the Committee of the Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Motion was made by Trustee Mueller, seconded by Trustee Brennan to adopt and place on file RESOLUTION 2024-R-088 APPROVING A CONTRACT BETWEEN THE VILLAGE OF TINLEY PARK AND SKC CONSTRUCTION, INC. FOR THE 2024 PAVEMENT CRACK FILL PROGRAM. This contract with SKC Construction, Inc. is in the amount of $168,000. This item was discussed at the Committee of the Whole meeting held prior to this meeting. President Glotz asked if there were any comments from members of the Board or public. There were none. Vote on roll call. Ayes: Brady, Brennan, Mahoney, Mueller, Shaw, Sullivan. Nays: None. Absent: None. President Glotz declared the motion carried. 

President Glotz asked if there were any comments from members of the Staff. 

Marketing Director Donna Framke announced the Tinley Park Block Party will take place this weekend, July 20 from 2 to 10 p.m. and July 21 from noon to 7 p.m. at Zabrocki Plaza. 

Ms. Framke also commended Marketing Program Specialist Kelly Oswald for her work with the Farmers Market. 

Public Works Director John Urbanski thanked the Public Works staff for their hard work during and after the storm that occured on July 15. 

President Glotz asked if there were any comments from members of the Board. 

Trustee Shaw passed on resident compliments to the Public Works Department for their hard work during and after the July 15th storm. 

Trustee Brady sent kudos to the Marketing Department for a job well done on the Farmer's Market. He also relayed comments from the residents regarding the good progress on the 94th Avenue construction. Trustee Brady thanked the Public Safety teams for their hard work during Rib Fest. 

President Glotz thanked the Public Works and Public Safety Departments for a job well done during and after the July 15th storm. He presented an overview of the ruling in the Villages' favor on case 2021 CH 3867 Eberhardt v. Village of Tinley Park by the Cook County Circuit Court. 

President Glotz announced a Property Tax Appeal Forum for Bremen-Rich-Orland Township on August 8th, 2024 at 6 p.m. in the Kallsen Center at the Tinley Park Village Hall. 

President Glotz stated concerns regarding the bidding opening held by the Tinley Park Park District for cleaning up the former mental health center property. 

President Glotz thanked Lisa Kortum for her hard work during the storm on July 15th. 

President Glotz asked if there were any comments from members of the public. 

Diane Galante stated concerns about Village Board and Village Officials. The Village President stated Order and decorum will be kept. Village Attorney Del Galdo stated that Ms. Galante made a statement of corruption which is per se defamatory. Ms. Galante stated she can say anything she wants. Village Attorney Del Galdo asked Ms. Galante to state the good faith basis she has to come to the belief that there's corruption. Ms. Galante continued with her concerns. Finally, Village Attorney Del Galdo stated that the record is clear that Ms. Galante's comments are not related to the Village President and neither good faith nor a reasonable basis to support the accusation against the Village President, the Village, or any Officials of the Village of corruption was presented. 

A resident stated safety and inconvenience concerns with the effects of the road construction at 175th Street and Ridgeland Avenue. She also stated concerns with students from the Tinley Park High School parking along Highland Avenue, as well as parents parking along Highland Avenue to pick up their children. The resident is concerned that once school is in session the problems will increase. President Glotz stated there will be additional police presence moving forward. He added that the Village Manager and Police Chief will discuss the matter with Tinley Park High School Principal Teresa Nolan. 

Chris Millerin stated concerns regarding a water main break on March 13th that resulted in a sinkhole on his and his neighbor's property. Mr. Millerin stated the pavement is worsening and believes this is becoming a safety hazard. He would like to know the timeline for repairs. He would like to see this repair prioritized. 

A resident stated concerns regarding the construction at 175th Street and Ridgeland Avenue. He added concerns about the school traffic on the sidewalk in front of his home. 

A resident stated concerns with watermain repairs on Highland Avenue. He also asked that the police monitor traffic coming in and out of Tinley Park High School. President Glotz noted that the high school traffic will be discussed with the high school administration. President Glotz stated that Public Works Director Urbanski will have his staff review the history of the water main on Highland Avenue and report this to the resident. 

Resident Larry Geraghty stated concerns with the Tinley Park Park District's project at the former Tinley Park Mental Health Center property. He stated his concerns about the bid process used by the park district and noted that the bidders were allowed to adjust their bids after they had been opened. He believed the bids were unclear. He also stated concerns about where surface water on the property would be pumped out. He is also concerned with the State legislation regarding the fact that no permit is needed for work on this project. He would like to see the Village involved. President Glotz stated there is no oversight on this project. Clerk O'Connor asked if he was referring to the water in the tunnels and basements. Mr. Geraghty stated the water he is referring to is outside the water in the tunnels and basements. 

A resident would like to have access to Highland Avenue from 175th for the residents who live on Highland (Local Traffic Only). She is looking for some relief from the inconvenience. 

Motion was made by Trustee Brennan, seconded by Trustee Mahoney, at 8:07 p.m. to adjourn to Executive Session to discuss the following: 

A. THE SALE OR PURCHASE OF SECURITIES, INVESTMENTS, OR INVESTMENT CONTRACTS.
